Sleeping in the Car – Breath Test Refusal – Charges Dropped!
Our client was parked behind a church and sleeping in his car with the engine running and the headlights on. There was an open bottle of vodka on the passenger's side. The police officer said our client failed field sobriety testing. The police arrested our client for DUI and charged him with driving on a suspended DUI license. Facing over 6 months in jail, we filed pre-trial motions arguing our client was not driving the vehicle.
