The police arrested our client who was sleeping in his car with engine and radio on after drinking at a local club. He was parked about one block away and told the police why he was in his car. We moved to throw out the charges because our client was not driving or operating the car - he did the right thing by “sleeping it off.”

The result: the Judge granted our motion, and the Commonwealth withdrew the charges.
