Sobriety Checkpoints Declared Illegal by the Pennsylvania Supreme Court!
The police stopped our client while traveling through a sobriety checkpoint illegally set up by the West Hills DUI Task Force. Our client's blood test result showed a blood alcohol content of .152%. The sobriety checkpoint was illegal because officers from 15 police departments were working outside of their respective jurisdictions. We lost at the county court level. We lost at the Pennsylvania Superior Court but we kept fighting all the way to the Pennsylvania Supreme Court.
The result: the Pennsylvania Supreme Court agreed with us and declared multi-jurisdictional DUI checkpoints illegal. All charges were dropped and there were no sanctions against our client's professional license.
