The police received a complaint from a local business claiming our client was drunk. An officer traced the license number and waited for the client around the corner from his home. The client drove past with no issues and properly turned into his driveway. Our client then went behind his house. The officer blocked the driveway with his car and went behind the house where he started questioning our client. He arrested him for DUI.

We moved to suppress the evidence arguing the police had no right to enter the area behind our client's home without a search warrant.

The result: the Judge granted our motion, ruling the traffic stop was illegal. All charges were withdrawn by the prosecution.
